By accessing or using IndianSMMPrime (the "Platform"), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our services.

Definitions & Scope

“Services” means promotional social media services (followers, likes, views, comments, engagement). These Terms apply to all users of the Platform.

General Agreement

  • By creating an account or placing an order you accept these Terms & Conditions.
  • IndianSMMPrime reserves the right to modify, suspend or terminate services or terms at any time; continued use constitutes acceptance.

Service Usage

  • We provide promotional Services for marketing and promotional purposes only. We are not affiliated with social platforms (Instagram, YouTube, Facebook, TikTok, etc.).
  • Services must not be used for spam, fraud, illegal, abusive, or harmful activities. Violation may result in account suspension.
  • All Services are provided “as-is” and results (growth, retention, reach) are not guaranteed.

Orders & Delivery

  • Orders are processed instantly or within the timeframe listed on each service page. Delivery times may be affected by third-party platform changes, API limits, or technical issues.
  • Customers must provide accurate profile links, usernames, or media URLs. Incorrect information may prevent fulfillment and may not be eligible for refund.
  • We do not guarantee permanent retention of followers/likes/views; social platforms may remove or alter engagements without notice.

Payments & Refunds

  • Payments are processed via trusted third-party gateways (Paytm, Razorpay, Stripe, etc.). IndianSMMPrime does not store sensitive card data.
  • Once processing of an order has started it cannot be canceled. Refunds are issued only for verified non-delivery or technical failure as per our refund policy.
  • Partial refunds or store credit may be provided where applicable. Unauthorized chargebacks may result in permanent account suspension and refusal of future service.

Account & Security

  • You are responsible for maintaining confidentiality of account credentials and for all activity under your account.
  • Do not share passwords. We will never request your password to fulfill orders.
  • Enable 2FA where available and use strong passwords. IndianSMMPrime is not liable for unauthorized access due to user negligence.

Privacy & Data

We collect the minimum information needed to provide Services (usernames, public profile links, order metadata, email for support). We do not sell personal data. Payment processors handle payment details and have their own privacy policies.

  • We implement SSL and reasonable security measures to protect data.
  • Third-party tools (analytics, payment gateways) may collect additional data; we recommend reviewing their policies.

Data Subject Rights (GDPR / CCPA)

If you are an EU or California resident you may request access, correction, export, or deletion of your personal data. To exercise your rights, contact support.

Intellectual Property

All content on the Platform, including text, design, graphics, logos and code, is the property of IndianSMMPrime or its licensors and protected by copyright and trademark laws. You may not reproduce or use our branding or content without prior written permission.

Prohibited Use

  • Do not use Services to promote illegal activity, impersonation, hate speech, or for scams/fraud.
  • Do not attempt to reverse-engineer, abuse, or manipulate delivery systems or APIs.
  • Violations may result in immediate account termination and no refund.

Indemnification

You agree to indemnify and hold IndianSMMPrime, its officers, agents and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or use of Services.

Limitation of Liability

  • To the fullest extent permitted by law, IndianSMMPrime’s total liability for any claims related to the Services is limited to the amount you paid us in the 6 months preceding the claim.
  • IndianSMMPrime is not liable for account suspensions, platform penalties, lost profits, special, indirect or consequential damages.

Warranty Disclaimer

Services are provided “as-is” and “as available”. IndianSMMPrime disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose.

Third-Party Services

We may use third-party providers (payment processors, analytics). We are not responsible for third-party terms or actions. Review their privacy and terms where applicable.

Force Majeure

IndianSMMPrime shall not be liable for delays or failures caused by events beyond our reasonable control, including natural disasters, acts of government, or platform outages.

Termination

We may suspend or terminate accounts or refuse service at our discretion, particularly if you breach these Terms or engage in prohibited activities. On termination, outstanding fees remain payable and we may delete account data as permitted by law.

Support & Disputes

Contact support first for order issues — we aim to respond within 24–48 hours.

Dispute Resolution & Jurisdiction

If we cannot resolve a dispute informally, both parties agree to attempt mediation before litigation. These Terms are governed by the laws of India. Jurisdiction: courts located in India.

Changes to Terms & Services

We may update these Terms or modify/terminate Services at any time. We will post changes on this page; continued use after changes means acceptance. Check the Effective date at the top for the latest revision.

Miscellaneous

  • These Terms constitute the entire agreement between you and IndianSMMPrime regarding the Services.
  • If any provision is invalid or unenforceable, the remaining provisions will remain in full force and effect.

Final Note

By using IndianSMMPrime you acknowledge that you have read, understood, and agreed to these Terms & Conditions. If you do not agree, please do not use our Services.
